You cannot place a lien against someone’s vehicle without their written consent. A common consensual lien is when an individual borrows money from a bank to purchase a vehicle and provides consent to the bank to place a lien on the vehicle. If you do not have consent, you will first need to file go through Small Claims court to obtain Judgment and subsequent Writ of Enforcement. Once you have that, then a Registry office can file the Writ/Lien in the PPR system.
